The Accompanist Backing Tracks Terms and Conditions

Scope of Services: These terms and conditions govern the provision of piano backing tracks ("Services") by The Accompanist to the client ("Client"). The Services encompass the creation of customized piano accompaniment tracks, including but not limited to full-length songs, song cuts, and note-bashes, as per the specifications provided by the Client.

Pricing and Payment: The Client shall pay The Accompanist in advance of any work done for the Services rendered in accordance with the following pricing structure:

Full-Length Songs: A base rate of £21.80 plus £7.70, £8.80, or £9.90 per additional minute, contingent upon the complexity of the song and materials provided.

Song Cuts: £16.80 per cut.

Note-Bashes: £7.70 per track.

Orchestral or Band backing tracks: £7.70 per instrument per minute if a full instrumental score is provided. £12.50 per instrument per minute where a score is not provided.

Additional discretionary charges may be applied based on the complexity of the project. Payment is due in full prior to the commencement of Services. [Your Company Name] reserves the right to withhold Services until payment is received in full.

Sheet Music Requirement: The Client must furnish legible sheet music, if available. In the absence of sheet music, a base rate of £37.50 shall be levied for a 3-minute track, with an additional charge of £12.50 per minute thereafter.

Tempo Alterations: Unless expressly specified by the Client, tracks shall be recorded in accordance with the tempo indicated on the provided sheet music or the original song. Any requests for tempo alterations shall incur an additional charge of £7.70 per song.

Delivery: Standard delivery of completed tracks shall be within 2-3 working days. An expedited delivery option is available at an additional charge of £7 for delivery within 48 hours, or £14 for delivery within 24 hours.

Intellectual Property and Usage Rights: The Client warrants that they possess the requisite rights and permissions to utilize any provided material. [Your Company Name] grants the Client a non-exclusive, non-transferable license to use the provided piano backing tracks solely for personal and non-commercial purposes.

Cancellation and Refunds: The Client may cancel Services prior to commencement, subject to a cancellation fee. Once Services have commenced, refunds shall be issued at the discretion of The Accompanist based on the stage of completion. No refunds shall be provided for completed Services.

Revision and Additional Charges: In the event that the Client provides an unclear or insufficient brief, resulting in the delivered product not meeting the Client's expectations, The Accompanist reserves the right to charge additional fees for any revisions required to meet the Client's specifications. The Client shall be responsible for clearly articulating their requirements and providing necessary feedback during the production process to avoid such additional charges. The extent and nature of these additional charges shall be determined at the discretion ofThe Accompanist based on the complexity of the revisions required.

Cancellation fees for Provision of Backing Tracks: In order to ensure fairness and to cover the costs associated with production and preparation, we have implemented the following cancellation policy: Cancellation within 2-3 Working Days: Day 1: A cancellation fee of 25% of the total order amount will be applied. Day 2: A cancellation fee of 50% of the total order amount will be applied. Day 3: A cancellation fee of 100% of the total order amount will be applied, and no refund will be issued. Please note that working days are considered Monday through Friday, excluding public holidays. Cancellation requests must be submitted in writing via email and must include the order details and reason for cancellation. Refunds for cancellations will be processed within 10 working days from the date of cancellation approval. By proceeding with your backing tracks order, you acknowledge and agree to abide by this cancellation policy.

Indemnification: The Client agrees to indemnify, defend, and hold harmless The Accompanist, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with the Client's use of the Services.

Modification and Termination: The Accompanist reserves the right to modify or terminate these terms and conditions, or any aspect of the Services, at any time without prior notice.

Governing Law and Jurisdiction: These terms and conditions shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of [Your Jurisdiction].

By engaging The Accompanist for the provision of Services, the Client acknowledges and agrees to be bound by these terms and conditions.
